Pine Plains, NY ADU Rules: One of the Biggest Size Caps in the Region

Pine Plains allows one of the more generous accessory dwelling sizes anywhere in the Hudson Valley: up to 1,250 square feet, or 75% of your principal dwelling's gross floor area, whichever is less — and the Planning Board can waive the cap up to the full 75% in the right circumstances. On the small end, the minimum is just 250 square feet, which leaves plenty of room for a compact studio if that's what makes sense for your lot.


The unit can be attached to your home or fully detached, as long as it stays out of the front yard and any required side or rear yard. Approval runs through a special use permit, and you'll need to show the Town that water and sewer service meets Dutchess County Health Department standards before you get the green light. If the unit is attached, the design has to preserve your home's single-family street appearance — no obvious duplex conversion look.


One condition to plan around: either the principal dwelling or the accessory dwelling has to be owner-occupied for as long as the special use permit is active. This isn't a one-time check — it's tied to the ongoing life of the permit.


The bottom line: If square footage is your priority — a real guest house, not a converted closet — Pine Plains gives you more room to work with than most of its neighbors.
